Description
Responding to subpoenas and other legal requests for medical records can be complex, requiring Release of Information (ROI) professionals to understand disclosure requirements while protecting patient privacy. This webinar examines the different types of subpoenas, including state, out-of-state, federal, regulatory, and grand jury subpoenas, and their application in civil, domestic, criminal, workers’ compensation, and regulatory matters.
Participants will explore court orders, qualified protective orders, satisfactory assurances, minute orders, objections, and motions to quash. Special attention will be given to identifying when state laws may impose additional requirements and when further research or escalation may be necessary. Through practical examples, participants will gain the knowledge and confidence to evaluate legal requests, determine appropriate responses, and support compliant disclosure practices.
Objectives:
- Distinguish between common types of subpoenas and other legal requests for medical records
- Determine how jurisdiction and case type may affect disclosure requirements and response deadlines
- Evaluate whether legal requests and supporting documentation provide sufficient authority for disclosure
- Identify circumstances requiring objections, motions to quash, additional research or escalation before disclosure
* Training materials recommended for ROI Microcredential certification exam preparation
